Il diritto come discorso
SILVIA FERRERI – CDCT Working Paper 39-2015 / CTL 16
Abstract: Starting from an analysis of the book Il diritto come discorso by Aurelio Gentili (Milan 2013), the contribution highlights a number of issues relating to the language and style of argumentation of different legal traditions in a world in which the myth of the rule-making state is in crisis and the understanding of the law requires a pluralistic and dialogic approach. Particularly, some aspects of language and style of argumentation are
considered in civil law and Anglo-American common law, also with reference to the Indian experience and to the influence of pre-colonial culture, remarking that the role of lawyers in the diversity of legal experiences is always that of making order in a multifaceted legal reality through discourse.
