The Italian “Eternit Trial”: Litigating Massive Asbestos Damage in a Criminal Court
Abstract: Italy is one of the countries where the production of materials made out of asbestos has caused a high number of deaths, massive damage to human health, and to the environment. This paper is dedicated to the biggest case ever litigated in Europe in this matter, namely the so-call Eternit Trial (processo Eternit) which has been unfolding before the criminal courts of Torino. The case is not yet closed, and a further appeal is pending before the Italian Corte di Cassazione, but the first instance judgment and the ruling of Court of Appeal in this matter call for attention, because of the high number of claimants involved in the case, and the large amount of damages awarded by the Court. The paper introduces the context of this litigation, and discusses its features for the benefit of foreign readers.
