Diversità del diritto e delle culture: un’introduzione

Cattura DOMENICO MICCO – CDCT Working Paper 17-2013/ELC9

Abstract: The bout with the Other is always a tough meeting: it happens, in fact, on the “screen of diversity” – biological or cultural dissimilarity – and it always highlights what makes them different from us. This creates an obstacle along the path leading to the elaboration of an all-inclusive human condition. Law is a product of cultures. It follows their rules and their dynamics; it is shaped and renewed but it is not able to exclude from its future the arduous encounter with legal models reflecting other views of the world. Law grows out of and is nourished by diversity, as any other cultural object. It is relative, like any cultural product
